What is a 1983 Claim?

The Mississippi Tort Claims Act provides governmental entities with immunity for the negligent acts of their employees. However, there are certain intentional acts or grossly negligent acts that will give you a legal cause of action. The government is liable if a law enforcement officer commits assault, battery, false imprisonment, false arrest, abuse of process or malicious prosecution. If a police officer or other governmental official abuses his authority under state law through any of these types of misconduct, both he and the governmental entity may be held liable for their misconduct.
